This is a very gray area. Who determines what is fictitious?

I think there is really no such thing as a fictitious marriage, but for the immigration authorities (especially the Americans) they will investigate in depth what the reason for the marriage is etc. and while I think marriage for the purpose of an immigration visa is a good enough reason to get married, immigration authorities will not accept it.
